Aventura Office Condo Owners Allege Construction Defects

The association for a 12-story office condo tower near Aventura accuses developer H&M Development of shoddy construction.

The Beacon Tower of Aventura Commercial Condominium Association is suing the developer of the building at 20200 West Dixie Highway in Miami-Dade Circuit Court, according to documents filed last week.

The association includes president Dr. Joshua Lampert, a plastic surgeon who runs his business in the tower; vice president Freddy Boulton; and treasurer Joaquim Cavalgnac, according to records. The tower, built in 2016, houses eight 141-square-foot office retail units, according to the lawsuit.

The condo association does not cite an exact dollar amount that it is seeking, but repairs made so far total more than $100,000, according to the lawsuit.

Landmark Case Eases Ability To Sue Over Construction Defects

UPDATED November 4, 2020, 12:19 p.m.: New York City condo investors may increasingly find themselves having to dig into their wallets to pay for any construction defects, according to a new court ruling.

The Appellate Division of state court upheld a ruling last week that a condominium board does not have to prove a fiduciary or confidential relationship between itself and the building’s sponsor when suing over construction defects.

The ruling, if it stands, will make it easier for condo boards suing over construction defects to claw back money that investors earned from the project, according to condo attorneys.

The ruling came as part of years-long dispute over construction defects between the condominium board at a Financial District building and Louis Greco’s Second Development Services and other sponsor entities involved in the development.
